AIRO SPACE KIDS TERMS AND CONDITIONS

§ 1 General information

1. The entity running Airo Space Kids is Fun Lab spółka z ograniczoną odpowiedzialnością, based in Warsaw, +48 22 379 55 75, address: ul. Łopuszańska 22, 02 - 220 Warsaw, entered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for the Capital City of Warsaw, XIV Economic Division of the National Court Register, under KRS number: 0000633427, NIP: 5223070000, REGON: 365242230, with a share capital of PLN 100,000.00 (in words: one hundred thousand PLN), hereinafter referred to as the "Manager".
2. The Manager provides services to Clients which include making Airo Space Kids available for use in accordance with its intended purpose for a fee.
3. These Terms and Conditions regulate the rules applicable to all persons staying at Airo Space Kids, hereinafter referred to as "Customers". Customers are Children, Parents, Guardians (adults) and Accompanying Persons.
4. The provisions of these Regulations may be supplemented by the content of other regulations with which the Customer is obliged to get acquainted, in particular the Complaint Procedure, the content of instructions and rules for using particular attractions or zones located on the premises of Airo Space Kids. In the case of the introduction of specific regulations, the provisions of these Regulations remain in force and continue to be binding.

§ 2 Payment terms

1. The use of Airo Space Kids is subject to a fee. The entrance fees are set out in the Airo Space Kids Price List, hereinafter referred to as the "Price List".
2. The price list is available at the Airo Space Kids reception and on the website www.airo.fun.
3. Tickets are sold online at www.airo.fun (in accordance with the procedure set out in the AIRO Electronic Payment Regulations) or at the reception, subject to the availability of seats for the hour in question.
4. For safety reasons and for the comfort of our customers, the number of people who can use Airo Space Kids at the same time is limited. If the limit is reached, ticket sales will be discontinued.

§ 3 Tickets

1. The ticket is stored on an electronic RFID bracelet, hereinafter referred to as the "Bracelet". It is possible to save several tickets on one Bracelet.
2. The tickets entitle the customer to stay at Airo Space Kids during the specific time period purchased by the customer.
3. The length of stay is calculated from the moment the bracelet is issued to the Client until the Client returns the bracelet. Upon termination of the use of Airo Space Kids, the Client is obliged to return the Bracelet at the reception desk. In the case of writing several tickets on one Bracelet and termination of the use of Airo Space Kids by some persons, the Client is obliged to inform the reception about it.
4. The bracelet is assigned to an individual Customer. It is prohibited to share or transfer the Bracelet to other Customers or third parties.
5. If the Bracelet is lost, damaged or destroyed, a fee of £20 will be charged.
6. If the length of stay prepaid by the Customer is exceeded, a charge will be made for each additional minute in the amount specified in the Price List.
7. It is possible to buy named passes entitling to multiple entries to Airo Space Kids according to the Price List. Presentation of the Pass is a necessary condition for issuing the Bracelet. In the case of non-use of the Pass, the terms and conditions of refunding the price of the Pass are specified in § 9 of the Rules and Regulations of Airo Space Kids.

§ 4 Entry rules for Airo Space Kids

1. Airo Space Kids is exclusively for Children aged 0 to 10 years.
2. Children under the age of 6 can only use Airo Space Kids when accompanied by a Parent or Guardian.
3. Children who are 6 years of age or older may use Airo Space Kids under the supervision of a Parent or Guardian or on their own, provided, however, that the Parent or Guardian has given prior written consent, hereinafter referred to as "Consent".
4. A maximum of 15 Children may be in the Airo Space Kids area at any one time under the supervision of a Parent or Guardian.
5. The determination of the Child's age will be based on the date of birth as determined in accordance with the Parent or Guardian's statement.
6. Consent can only be given on the form provided by the Manager and must be signed by the Child's Parent or Guardian. The Consent Form must be completed each time a ticket is purchased for a Child.
7. Consent which is incomplete or illegible or which does not contain the signature of the Parent or Guardian is invalid and will not be accepted by the Staff.
8. Children can use the Airo Space Kids independently on the basis of Consent for a maximum of 180 minutes. At the end of this time, the Parent or Guardian is obliged to turn up and personally check the condition of the Child. Otherwise, after an unsuccessful attempt at contact, the appropriate authorities will be notified of the Parent or Guardian leaving the Child.
9. The Parent or Guardian should decide on the Child's use of the attractions offered at Airo Space Kids taking into account the Child's abilities, skills and state of health as well as the resulting limitations and risks, in particular bearing in mind the risk of injury and trauma.
10. Children with any health problems, where physical exertion could even potentially endanger their life or health, should not use the Airo Space Kids attractions for their safety.
11. Before entering Airo Space Kids, customers are required to leave outerwear, footwear, backpacks, bags and other items that are not permitted to be brought into Airo Space Kids. Valuables can be left in the deposit lockers.
12. Entry to the Airo Space Kids area is permitted in clothing that allows free and safe play, in particular with pockets emptied and without any sharp or loose items that could cause problems or pose a danger during play.
13. The Manager, in justified cases, reserves the right to refuse admission to the area of Airo Space Kids each time after providing a justified reason for the refusal. In such a situation, the Client is entitled, at the Client's choice, to a refund of the price of the Ticket according to the principles specified in § 9 of the Regulations of Airo Space Kids or to a change of the date of the visit provided that a new date of the visit preferred by the Client is available.

§ 5 General rules for the use of Airo Space Kids

1. Staff provide Childcare for an additional fee as provided in the Price List.
2. In the event of non-compliance with the provisions of the Rules and Regulations, the Child and Parent or Guardian will be instructed about the content of the Rules and Regulations and summoned to comply with the provisions of the Rules and Regulations, with the threat that in the event of further non-compliance with the provisions of the Rules and Regulations, the Customer may be expelled from Airo Space Kids. If, despite the content of the instructions and summons, the Child and Parent or Guardian continue to disobey the provisions of the Rules and Regulations, thus creating a danger to themselves or others, creating a risk of damage or destruction of equipment or interfering with the use of Airo Space Kids attractions by other persons, the Child and Parent or Guardian may be expelled from Airo Space Kids.
3. In the Airo Space Kids area, which is separated by a carpet, each customer is only allowed to wear socks or shoe protectors. Entering in shoes or barefoot is strictly prohibited.
4. The consumption of food and drinks is only allowed in AIRO CAFE.
5. There is an absolute ban on the Airo Space Kids area.

1. bringing or possessing weapons or other dangerous objects, drugs, intoxicants and any object that could cause a danger to the life or health of the occupants of Airo Space Kids,
2. the carrying and consumption of alcoholic beverages of any kind,
3. to bring in and consume their own food and beverages, excluding meals with a special purpose due to the age or health of the client,
4. smoking and electronic cigarettes,
5. to consume food and drinks bought at AIRO CAFE in places not intended for this purpose,
6. chewing gum while playing,
7. indecent behaviour, use of vulgar and offensive words,
8. introduction of animals.

1. Entering and leaving the zones and attractions located in Airo Space Kids may only take place in areas designated for this purpose.
2. It is the responsibility of each Customer to immediately report to Airo Space Kids Staff any violations of the Rules and Regulations and other unsafe behaviour by other Customers.
3. Information about an accident taking place on the premises of Airo Space Kids, as well as the need for first aid, can be reported to any employee of Airo Space Kids. In such an accident, Airo Space Kids staff will immediately provide pre-medical first aid and, if necessary, call for medical assistance.
4. The Toddler Zone, located on the mezzanine floor of Airo Space Kids, is designed for children aged 0-4 years.
5. Children using the Toddler Zone must be accompanied by an adult. Staff do not provide childcare for children using the Toddler Zone.    
6. The Toddler Zone should only be used in socks or tights.
7. The Toddler Zone can be used by no more than 15 children and no more than 15 adults at any one time.
8. The Go-Karts can be used by children who are at least 100 cm tall.
9. Tokens are available from the Playroom Staff.
10. The Ticket price includes two free tokens for the Gokarts. Additional tokens are charged according to the Price List.
11. No more than 5 Children using the Go-Karts may be on the Go-Kart track at any one time.
12. It is forbidden to stay on the go-kart track outside the Go-Kart.
13. One Child is allowed to stay in one Gokart.
14. In the event of a malfunction of the Go-Karts, the problem must be reported to Personnel immediately.
15. The double Go-Karts can only be used by a Parent with a child from 90 cm in height.
16. The attractions in the Interactive Zone must be used for their intended purpose.
17. In the event of a malfunction of the attractions located in the Interactive Zone, the problem must be reported to Personnel immediately.
18. In the area with slides, ball pool, ladders, ropes, trampolines and other obstacles (hereafter referred to as the "Monkey Grove") special care should be taken due to the large number of Children using the above mentioned attractions.
19. It is forbidden to jump into the ball pool, to carry balls out of the pool, to slide down the slide with your head down and on your stomach, to climb onto the slide from below, to jump off the slide and any other improper use of the slide.
20. There can only be one Child on the trampoline at any one time.
21. It is forbidden to climb on the constructions of the attractions not intended for children's play located in the Monkey Grove.
22. The red slide is designed for children aged 7 years and over and can be used under Staff supervision.
23. Only one Child is allowed to slide on one pontoon.
24. It is forbidden to move pontoons intended for sliding on the slide outside the places designated for their storage and keeping. Pontoons may only be used on the slide designated for this purpose.
25. It is forbidden to jump on the wheels or to use them for any other purpose than sliding down the slide.

§ 6 Liability

1. The use of Airo Space Kids involves a risk of injury or damage to persons and property. This risk applies in particular to Children who have any health contraindications and Children with disabilities. For liability for damage, the general rules set out in the generally applicable legislation, in particular the provisions of the Civil Code Act, apply.
2. Parents or Guardians, as part of their duty of supervision, may be held liable for damage caused by them, as well as that caused by the Children in their care, on the general principles set out in generally applicable legislation, in particular under the provisions of the Civil Code Act.
3. The Manager is not responsible for interruptions in functioning of Airo Space Kids as a result of force majeure or caused by circumstances beyond the Manager's control, in particular resulting from power cuts. In the case of interruption in functioning of Airo Space Kids, the Client is entitled, at the Client's choice, to a refund of the Ticket price according to the principles specified in § 9 of the Regulations, or to a change of the date of the visit, provided that a new date of the visit preferred by the Client is available.

§ 7 Monitoring and protection of personal data

1. Airo Space Kids is monitored. The image from the cameras is recorded to ensure the highest level of security and only for this purpose the personal data of the Customers, i.e. their image, is processed.
2. By entering its premises, Airo Space Kids customers consent to their image being recorded while on Airo Space Kids premises.
3. The administrator of the personal data is Fun Lab Sp. z o.o. with its registered office in Warsaw, 22 Łopuszańska Street, entered in the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, XIV Business Division of the National Court Register under the KRS number 0000633427, share capital PLN 100,000, NIP: 5223070000.
4. The Customers' personal data referred to in this paragraph will be processed for the purpose of ensuring security at Airo Space Kids on the basis of Article 6(1)(f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. (hereinafter "RODO").
5. The Customers' personal data referred to in this paragraph will be stored for a period of 14 days or for the period necessary to establish, assert or defend possible claims.
6. The Customers' personal data referred to in this paragraph will not be made available to third parties for processing purposes.
7. Customers have the right of access to the content of their data and, depending on their rights under the RODO, the right to rectification, erasure, restriction of processing, the right to object.
8. The data provided will not be processed by automated means (including profiling).
9. The data provided will not be transferred outside the European Economic Area.
10. Customers have the right to lodge a complaint with the President of the Data Protection Authority if they consider that the processing of the personal data provided violates the provisions of the RODO.
11. The Manager is not liable for infringement of personal rights and processing of personal data in the form of images of Clients by third parties in connection with recording or publicising (e.g. in social media) images of Clients by such persons.

§ 8 Supplementary rules

1. The manager reserves the right to reserve the entire Airo Space Kids or specific parts of it for special events.
2. For all matters not covered by the Terms and Conditions or specific regulations, please contact the Airo Space Kids Staff.
3. In matters not covered by the Rules, the provisions of the Civil Code and other laws shall apply.
4. Any additional information is posted on the website www.airo.fun.

§ 9 Terms and conditions of refunds

1. In the event of non-use of a Ticket for reasons attributable to the Manager or for reasons other than those attributable to the Client, in particular due to interruption in the operation of Airo Space Kids as a result of force majeure or caused by circumstances beyond the Manager's control, at the request made by the Client, the Client is entitled, at the Client's choice, to a refund of the entire price of the Ticket or a change of the date of the visit, provided that a new date preferred by the Client is available.
2. In the event that the Pass is not used in its entirety by the Client for reasons attributable to the Manager or for reasons other than those attributable to the Client, in particular due to the interruption of Airo Space Kids' operations as a result of force majeure or caused by circumstances beyond the Manager's control, the price of the Pass is refunded in full upon request by the Client.
3. In the event that the Pass is not used in part by the Client for reasons attributable to the Manager or for reasons other than those attributable to the Client, in particular due to an interruption in the operation of Airo Space Kids as a result of force majeure or caused by circumstances beyond the control of the Manager, the price of the Pass shall be refunded at the request of the Client in the part determined as follows:

1. in the case of an Open Pass with an unlimited number of entrances on a specific date, for a portion corresponding to the number of days on which the Customer was unable to use the Pass;
2. in the case of a Pass covering a predefined number of entrances on a specific date, on a pro rata basis according to the number of entrances used and not used within the period of validity of the Pass;
3. in respect of a Pass covering entries to classes with a trainer on predetermined dates - in proportion to the number of used and unused classes on the specified dates.

1. In the event that the price of a Ticket or Pass is paid by the Client and the Manager is unable to fulfil the order, the price of the Ticket or Pass shall be refunded in full.
2. In the event that the Manager refuses entry to Airo Space Kids on the basis of § 4.13 of these Rules and Regulations, at the request made by the Client, the Client shall be entitled, at his/her choice, to a refund of the total price of the Ticket or a change of the date of the visit, provided that a new date of the visit preferred by the Client is available. In the event that the Customer holds a Pass, at the request made by the Customer, the price of the Pass shall be refunded in part, applying the provisions of § 14.3.a-c above accordingly.
3. The manager shall make the reimbursement in cash or by transfer to the account indicated by the client.

§ 10 Amendments to the Rules of Procedure

1. The Manager reserves the right to unilaterally amend these Rules for valid reasons.
2. The following shall be regarded as valid reasons justifying an amendment to these Rules:

1. changes in legislation;
2. significant changes in the scope of the Manager's activities, in particular a change in the scope of the services provided or the introduction of new services or changes to existing services.

1. The Manager will inform Clients of any change to these Terms and Conditions by posting a relevant announcement on its website: www.airo.fun.
2. Amendments to these Terms and Conditions shall only apply to contracts concluded after the amendment date.
