AIRO ACTIVE PARK REGULATIONS
The AIRO ACTIVE PARK Trampoline Park ("Airo Active Park") is a place for fantastic fun, healthy physical activity as well as for experiencing unforgettable adrenaline experiences. However, we warn you that jumping on trampolines can be dangerous. The safety of our clients is our priority, which is why before entering Airo Active Park each client has the opportunity to watch an instructional video prepared by us, as well as enjoy a group warm-up conducted by professionals. Safety in Airo Active Park is supervised by qualified instructors, while first aid is provided by a lifeguard. Observing these Rules and Regulations is an essential condition for ensuring a safe and unforgettable activity, therefore every customer should read and adhere to its content.
§ 1 General information
- The entity running Airo Active Park is Fun Lab spółka z ograniczoną odpowiedzialnością, based in Warsaw, tel. +48 22 379 55 74, address: ul. Łopuszańska 22, 02 - 220 Warsaw, entered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for the Capital City of Warsaw, XIV Economic Division of the National Court Register, under KRS number: 0000633427, NIP: 5223070000, REGON: 365242230, with a share capital of PLN 100,000.00 (in words: one hundred thousand PLN), referred to as the "Manager".
- The Manager provides services to Clients which include making the Airo Active Park available for use in accordance with its intended purpose for a fee.
- These Rules and Regulations regulate the rules applicable to all persons staying on the premises of Airo Active Park, referred to as "Customers". Customers are Adults, Children (minors), Parents, Guardians (adults).
- The use of Airo Active Park is conditional on individual written or electronic acceptance of the content of these Rules and Regulations. The provisions of these Rules and Regulations may be supplemented by the content of other rules and regulations with which the Customer is obliged to familiarise himself, in particular the Complaints Procedure, the content of instructions and rules for the use of individual attractions or zones located on the premises of Airo Active Park. In the event of the introduction of specific regulations, the provisions of these Rules and Regulations remain in force and continue to be binding. The content of the Rules and Regulations is available at the reception of Airo Active Park and on the www.airo.fun.
- Airo Active Park employees are dressed in a business uniform with the AIRO logo.
§ 2 Payment terms
(1) The use of the Airo Active Park is chargeable. The amount of the entrance fee is specified in the Price List of the Airo Active Park, hereinafter referred to as the "Price List".
The price list is available at the reception of Airo Active Park and on the www.airo.fun.
3. the purchase of tickets can be made through the system available online at www.airo.fun or at the reception of Airo Active Park, subject to the availability of seats for the chosen time.
4 It is possible to purchase passes assigned to a Customer Account, entitling to multiple entries to Airo Active Park, in accordance with the Price List. The passes are personal. The validity of the pass starts from the day of purchase. Sales are conducted online and at the reception of Airo Active Park. In case of non-use of the Pass, terms and conditions of refunding the price of the Pass are specified in § 14 of the Rules and Regulations.
5 For safety reasons and for the comfort of our clients, the number of people who can use the Airo Active Park at the same time is limited.
6 In the event that the price is paid by the Customer and the Manager is unable to fulfil the order, the terms and conditions of refunding the price of the Ticket are specified in § 14 of the Regulations.
(7) Every sale shall be confirmed by a receipt. An invoice shall only be issued if this receipt contains the TIN. At the latest at the time of sale, the Customer must specify whether he/she is buying as a tax payer or as a consumer. When purchasing a Ticket at the reception, the TIN should be given to the cashier, and when purchasing a Ticket online, the TIN should be sent to the following address recepcja@airo.fun. If the Customer does not provide a TIN by the time the receipt is issued, he is deemed to be buying as a consumer. He may request an invoice, but the Manager will issue him an invoice as for consumers - without the TIN of the purchaser. The Manager issues and sends electronic invoices. Requests for invoices can be submitted in person or electronically to the following address recepcja@airo.fun.
(8) In accordance with Article 38(12) of the Consumer Rights Act of 30 May 2014. A customer who is a consumer does not have the right to withdraw from a contract concluded at a distance, as this right does not apply to contracts for the provision of services related to leisure, entertainment or sports events, if the contract specifies the day or period of service provision.
§ 3 Tickets
- The ticket is stored on an electronic RFID bracelet, known as the 'Bracelet'.
- Along with the Bracelet, customers are issued with paper wristbands to be worn throughout their stay at Airo.
- The ticket entitles the customer to stay at Airo Active Park for the specific unit of time purchased by the customer.
- The bracelet is assigned to the individual Customer. Upon termination of the use of Airo Active Park, the Customer is obliged to return the Bracelet to the so-called "drop box". It is prohibited to share or transfer the Bracelet to other Customers or third parties.
- If the Bracelet is lost, damaged or destroyed, a fee of £30 will be charged.
§ 4 Rules for entering the Active Park area
- Entry begins at a full hour with a mandatory safety briefing, the completion of which is a condition for the safe use of the Airo Active Park.
- A customer who fails to appear or is late for the security briefing is obliged to familiarise himself with the security rules.
- The Airo Active Park is designed for Children over the age of four and for Adults.
- A child may only use the Airo Active Park attractions with the written consent of the Parent or Guardian on the consent form available at www.airo.fun or at Reception.
- Children under 7 years of age can only use the Airo Active Park with the personal assistance of a Parent or Guardian who is present with the Child while exercising on the trampolines. In this case, it is necessary to purchase a ticket for the Child only, this ticket also includes the right of entry for one Parent or Guardian. In the case of a Parent or Guardian taking care of more than one Child on the premises of Airo Active Park, no additional guardians are required, however, the Parent or Guardian under whose custody the Children remain is obliged to supervise them at all times.
- Children who are at least 7 years of age and under 13 years of age may use the Airo Active Park under the supervision of a Parent or Guardian, who are required to be present on the AIRO premises at all times. The Parent or Guardian is not obliged to purchase a ticket, however, if they wish to use the attractions of the Airo Active Park, a separate ticket must be purchased.
- A maximum of fifteen (15) Children may be in the care of one Parent or Guardian at any one time in the Airo Active Park.
- Staff provide Childcare for an additional fee as provided in the Price List.
- The Parent or Guardian is obliged to familiarise the Child with the information contained in these Regulations.
- Before entering the premises of the Airo Active Park, clients are required to leave outerwear, footwear, backpacks, bags and other items which are not permitted to be brought into the premises of the Airo Active Park. Valuables can be left in the lockers.
- For important reasons such as: system failure, lack of electricity, violation of prohibitions referred to in § 5.7, the Manager may refuse access to the premises of Airo Active Park each time after providing a justified reason for such refusal. In such a situation, the Client is entitled, at the Client's choice, to a refund of the Ticket price according to the principles specified in § 14 of the Regulations or to a change of the date of the visit on condition that a new date of the visit preferred by the Client is available.
§ 5 General rules for using the Airo Active Park
- Each Customer decides on the use of the attractions offered at Airo Active Park taking into account his/her abilities, skills and state of health as well as the limitations and risks resulting from them, in particular taking into account the risk of injuries and trauma. In the case of Children, the aforementioned decision is made by the Parent or Guardian.
- People with any health problems, where physical exertion could even potentially endanger their life or health, should not use the Airo Active Park attractions for their safety.
- Entry to the trampoline area is only permitted with non-slip socks. Entering in shoes is strictly prohibited. Anti-slip socks can be purchased at the reception of Airo Active Park.
- The use of the Airo Active Park attractions is permitted in sportswear with empty pockets, without any sharp or loose parts that may cause problems or create hazards during physical activity and with hair pinned up.
- When using the Airo Active Park, it is imperative to follow the instructions and directions given by the Airo Active Park Staff.
- It is forbidden to use the Airo Active Park contrary to its intended purpose.
- There is an absolute ban on the Airo Active Park:
- the carrying and consumption of alcoholic beverages of any kind,
- smoking and electronic cigarettes,
- indecent behaviour, use of vulgar and offensive words,
- bringing in and using sports equipment or other items not approved by the Staff,
- bringing or possessing weapons or other dangerous objects, drugs, intoxicants and any object that may cause danger to the life or health of persons on the Airo Active Park.
- Clients wearing glasses or contact lenses should take special precautions.
- Entering and leaving the zones and attractions located in the Airo Active Park may only take place in areas designated for this purpose.
- If the Client fails to comply with the provisions of the Rules and Regulations, the Client will be instructed about the content of the Rules and Regulations and summoned to comply with their provisions, with the threat that if the Client continues to fail to comply with the provisions of the Rules and Regulations, the Client may be expelled from Airo Active Park. If, despite the content of the instructions and summons, the Customer continues to disobey the provisions of the Rules and Regulations, thereby creating a danger to himself or others, creating a risk of damage or destruction of Airo Active Park equipment or interfering with the use of Airo Active Park attractions by other persons, the Customer may be expelled from Airo Active Park.
- It is the responsibility of each Customer to immediately report to Airo Active Park Staff any breaches of the Rules and Regulations and other unsafe behaviour by other Customers.
- Information about an accident taking place on Airo Active Park premises, as well as the need for first aid, can be reported to any Airo Active Park staff member. In such an accident, the Staff will provide immediate pre-medical first aid, call a lifeguard and, if necessary, summon medical assistance.
§ 6 Principles of safe exercise
- Any activity involving the use of trampolines should begin with a warm-up. The warm-up should include exercises activating all joints and muscle groups. At the beginning of each training session, the Airo Active Park staff conducts a warm-up. Each person should take part in it in order to prepare the body for physical effort and reduce the risk of injury.
- When jumping, avoid falls on the head, neck, neck shoulders, elbows, straight arms, straight legs.
- Only one person is allowed per trampoline when jumping, unless otherwise decided by the Staff.
- In order to move from a trampoline to another trampoline or to get to another part of the Airo Active Park, it is necessary to use caution, observe other people, keep a safe distance, move carefully on the mats laid between the trampolines.
- It is forbidden to enter, jump on, run over trampolines where other people are present.
- It is forbidden to:
- perform dangerous stunts without assistance from Personnel,
- Entering the Air Bag, Tower, Trapeze, Wall Run, Twister, Climbing areas without the permission of the Airo Active Park Staff or in their absence,
- sitting and jumping on the mats between the trampolines and on their sides,
- seating on mats to protect structural elements,
- jumping into safety nets,
- performing evolutions over elements located between trampolines without the assistance of a trainer (mats, connecting elements, springs),
- eating, drinking drinks and chewing gum in the trampoline area,
- placing any objects on the mats and mattresses between the trampolines as well as on the rest of the area known as the trampoline area,
- running throughout the trampoline zone.
- After the announcement of the end of a unit, leave the trampoline area immediately, with caution.
- Extreme caution is advised when leaving the trampoline area so as not to pose a danger to other users.
§ 7 Rules for the use of climbing walls
- The use of climbing walls is only possible with the permission and assistance of a coach.
- Children under 8 years of age are only allowed on the climbing wall under the supervision of a Parent or Guardian or as part of an activity run by Airo Acitve Park Staff.
- Each client must have his/her self-rescue clipped in by Airo Active Park staff before climbing.
- Always check that the device retracts the rope before climbing.
- Climbing is permitted with non-slip socks or indoor sports shoes with soft soles.
- Climbing is only permitted using equipment provided by Airo Active Park.
- The number of people allowed to climb at the same time is limited. The number of people allowed to use the attraction at one time is decided by the Airo Active Park Staff.
§ 8 Principles of using the Ninja Tracks
- Special care should be taken when ascending and descending obstacles.
- When overcoming obstacles, be aware of others using the track.
- Do not step on an obstacle used by another person.
- Before entering the obstacle in question, ensure that there are no other people using the track in the landing area underneath the airbag.
- It is forbidden to rest, lie down or stay for an extended period of time on the air cushion, which must be lowered immediately after falling from the obstacle.
§ 9 Rules of use of Twister
- The Twister can be used by people who are at least 135 cm tall.
- The Twister attraction can be used by up to eight people at a time.
- Jumping over the upper arm of the Twister is prohibited.
- You may only enter the unit after a clear announcement from Personnel.
- Staff may designate a place for the client to enjoy the attraction.
- Once "knocked down" and clearly communicated by the Personnel operating the unit, leave immediately.
- The device may only be operated by Airo Active Park personnel. Customers are not allowed to operate the control panel.
§ 10 Terms of use of the Trapeze
- The Trapeze can be used by people who can reach the bar independently.
- Only one person can use the Trapeze at a time.
- You may only enter the unit after a clear announcement from Personnel.
- Jumping off the trapeze into the sponge pool should be done on bent legs or on the back. It is forbidden to jump on the head, neck, abdomen, face or hands as there is a risk of injury.
- After jumping off, leave the sponge pool immediately to free up a landing spot for the next person.
§ 11 Liability
- The use of the Airo Active Park involves a risk of injury or damage to the body and property, and liability for damages shall be governed by the general rules set out in generally applicable legislation, in particular the provisions of the Civil Code Act.
- Clients and Parents or Guardians, as part of their duty of supervision, may be held liable for damage caused by them, as well as that caused by Children in their care, on the general principles set out in generally applicable legislation, in particular under the provisions of the Civil Code Act.
- The Manager is not responsible for interruptions in Airo Active Park's operation which are the result of force majeure or caused by circumstances beyond the Manager's control. In the event of interruption in Airo Active Park's operation, the Client is entitled, at the Client's choice, to a refund of the Ticket price according to the principles specified in § 14 of the Regulations or to change the date of the visit on condition that a new visit date preferred by the Client is available.
§ 12 Monitoring and protection of personal data
- Airo Active Park is monitored. The images from the cameras are recorded to ensure the highest level of security and only for this purpose are the personal data of the clients, i.e. their image, processed.
- By entering its premises, Airo Active Park's customers consent to the recording of their image during their stay on Airo Active Park's premises.
- The administrator of the personal data is Fun Lab Sp. z o.o. with its registered office in Warsaw, 22 Łopuszańska Street, entered in the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, XIV Business Division of the National Court Register under the KRS number 0000633427, share capital PLN 100,000, NIP: 5223070000.
- The Customers' personal data referred to in this paragraph will be processed for the purpose of ensuring security at Airo Active Park on the basis of Article 6(1)(f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. (hereinafter "RODO").
- The Customers' personal data referred to in this paragraph will be stored for a period of 30 days or for the period necessary to establish, assert or defend possible claims.
- The Customers' personal data referred to in this paragraph will not be made available to third parties for processing purposes.
- Customers have the right of access to the content of their data and, depending on their rights under the RODO, the right to rectification, erasure, restriction of processing, the right to object.
- The data provided will not be processed by automated means (including profiling).
- The data provided will not be transferred outside the European Economic Area.
- The Manager is not liable for infringement of personal rights and processing of personal data in the form of images of Clients by third parties in connection with recording or publicising (e.g. in social media) images of Clients by such persons.
§ 13 Supplementary rules
- The manager reserves the right to reserve the entire Airo Active Park or individual parts of it for special events.
- Complaints regarding electronic payments are dealt with by the service manager www.przelewy24.pl.
- For all matters not covered by the Terms and Conditions or specific regulations, please contact Airo Active Park Staff.
- In matters not covered by the Rules, the provisions of the Civil Code and other laws shall apply.
- All additional information is posted on the website www.airo.fun.
§ 14 Terms and conditions of refunds
- In the event of non-use of a Ticket for reasons attributable to the Manager or for reasons other than those attributable to the Client, in particular due to interruption in the operation of Airo Active Park as a result of force majeure or caused by circumstances beyond the control of the Manager, at the request of the Client, the Client is entitled, at his/her choice, to a refund of the entire price of the Ticket or a change of the date of the visit, provided that a new date preferred by the Client is available.
- In the event that the Pass is not used in its entirety by the Client for reasons attributable to the Manager or for reasons other than those attributable to the Client, in particular due to interruption in the operation of Airo Active Park as a result of force majeure or caused by circumstances beyond the control of the Manager, the price of the Pass is refunded in full upon request by the Client.
- In the event that the Pass is not used in part by the Client for reasons attributable to the Manager or for reasons other than those attributable to the Client, in particular due to an interruption in the operation of Airo Active Park as a result of force majeure or caused by circumstances beyond the control of the Manager, the price of the Pass shall be refunded at the request of the Client in the part determined as follows:
- in the case of an Open Pass with an unlimited number of entrances on a specific date, for a portion corresponding to the number of days on which the Customer was unable to use the Pass;
- in the case of a Pass covering a predefined number of entrances on a specific date, on a pro rata basis according to the number of entrances used and not used within the period of validity of the Pass;
- in relation to a Pass covering entries to classes with a trainer on predetermined dates - in proportion to the number of used and unused classes on the specified dates. If the price of a Ticket or Pass is paid by the Client and the Manager is unable to fulfil the order, the price of the Ticket or Pass is refunded in full.
- In the event that the Manager refuses access to the premises of Airo Active Park on the basis of § 4.11 of these Rules and Regulations, upon the request made by the Client, the Client is entitled, at his/her choice, to a refund of the entire price of the Ticket or a change of the date of the visit on the condition that a new date of the visit preferred by the Client is available. If the Customer holds a Pass, upon request notified by the Customer, the price of the Pass shall be refunded in part, applying the provisions of § 14.3.a-c above accordingly.
- In the event of the Customer's withdrawal from the contract due to non-acceptance of the amendments to these Terms and Conditions as specified in § 15 hereof, the entire price of a Ticket or the entire or a part of the price of a Pass shall be refunded accordingly - for the refund of the price of a Ticket § 14.1 above shall apply, and for the refund of the price of a Pass § 14.2 or § 14.3 a-c above shall apply respectively.
- The manager shall make the reimbursement in cash or by transfer to the account indicated by the client.
§ 15 Amendments to the Rules of Procedure
- The Manager reserves the right to unilaterally amend these Rules for valid reasons.
- The following shall be regarded as valid reasons justifying an amendment to these Rules:
- changes in legislation;
- significant changes in the scope of the Manager's activities, in particular a change in the scope of the services provided or the introduction of new services or changes to existing services;
- The Manager will inform Clients of any change to these Terms and Conditions by posting a relevant announcement on its website: www.airo.fun.
- Amendments to these Terms and Conditions shall only apply to contracts concluded after the amendment date.
