§ 1 General information
- The entity running Airo Active Park is Fun Lab spółka z ograniczoną odpowiedzialnością, based in Warsaw, tel. +48 22 379 55 74, address: ul. Łopuszańska 22, 02 - 220 Warsaw, entered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for the Capital City of Warsaw, XIV Business Division of the National Court Register, under KRS number: 0000633427, NIP: 5223070000, REGON: 365242230, with share capital of PLN 100,000.00 (in words: one hundred thousand PLN), hereinafter referred to as "AIRO".
- The Manager provides a service to the participant in the Classes (hereinafter referred to as the "Participant") consisting of the organisation of group classes at Airo Active Park, hereinafter referred to as the "Classes", against payment.
- Classes are organised at Airo Active Park at 22 Łopuszańska Street in Warsaw and are for people of all ages - depending on the group.
- These Activity Regulations are in addition to the AIRO ACTIVE PARK Regulations. Participants are obliged to comply with the provisions of both Regulations.
§ 2 Reserving a place in a group
- Participation is subject to booking a place and paying for the class.
- Seat reservations can be made in person or by email.
- A participant can reserve a place in a group in a pass for one, two or four months. A place in the Classes is guaranteed on payment.
- If you wish to take part in a class, booking a place in the group is necessary at least 24 hours before the class. Payment for classes can be made by bank transfer to AIRO's bank account or by cash or card at AIRO's cash desks, upon confirmation of availability.
- The fees for the Classes are set out in the Price List.
- In the event of non-payment for the Class, the booking of a place in the group is cancelled.
- In the event of an absence from the Class notified no later than 24 hours prior to the Class, the Class Fee, at the Customer's choice, may be refunded under the terms of § 4 of the Class Rules, or the Customer may enter the trampoline park free of charge for two hours at any time during the term, subject to availability of places.
- AIRO reserves the right to cancel a group class if the number of enrolled persons for that class is less than 6. In such a case, the Class Fee is refundable according to the rules specified in § 4 of the Class Regulations.
- AIRO reserves the right to change the starting and ending times of the Classes, to change the type of Classes or the person of the instructor, and to cancel Classes in emergency situations or in the event of changes to the schedule. In such a situation AIRO informs the Participants of the changes, and the Participants may in such a situation inform AIRO within 14 days of cancellation of their participation in the Classes.
- In the event of cancellation of participation in the Classes, the Class Fee shall be refunded in accordance with the principles set out in § 4 of the Class Regulations.
- In the event of cancellation of an Activity, at the Customer's option, the Activity Fee shall be refunded under the terms of § 4 of the Activity Rules and Regulations, the Customer shall also have the option to enter the trampoline park free of charge for one hour at any time up to two months from the date of the cancelled Activity, subject to availability of places, or the Customer shall have the option to carry the fee for the unused Activity over to the next Activity.
§3 Participation in activities
- During their stay in the Trampoline Park, Participants are obliged to follow the recommendations and instructions of the instructor in charge of the Activity.
- The participant is obliged to enter the Classroom on time.
- The participant is obliged to inform the instructor prior to the Classes about injuries, deterioration and other serious health problems, as well as about an injury sustained during training.
- Before the first activity, the underage participant is required to show written permission from his/her parent/legal guardian to use the park and participate in the Activity.
- In the absence of the consent referred to above, the underage Participant shall not be allowed to participate in the Classes and the fee for such Classes shall be refunded in accordance with the principles set out in § 4 of the Class Rules or may be carried over to the next Classes.
§ 4 Terms and conditions of refunds
- In the event of a Participant's absence from an Activity, notified, at the latest, 24 hours prior to the Activity, the Fee for the Activity, upon the Participant's request, may be refunded, minus the amounts corresponding to the costs actually incurred by the Manager in organising the Activity in question, unless the Participant, instead of a refund, makes use of the possibility to enter the trampoline park free of charge for one hour at any time during the semester, subject to the availability of places.
- In the event of cancellation in the situation referred to in § 2.7 of the Rules and Regulations of Classes, the Fee for the Classes shall be refunded in full, unless the Participant, instead of a refund, makes use of the possibility to enter the trampoline park free of charge for one hour at any time during the term, provided that places are available.
- In the event of cancellation of classes in the situation referred to in § 2.8 of the Rules and Regulations of Classes, the Fee for such classes shall be refunded in full, unless the Participant, instead of a refund, makes use of the possibility to enter the trampoline park free of charge for one hour on any date within two months of the date of absence from the class on condition that places are available, or the Participant makes use of the possibility to transfer the fee for unused classes to the next class.
- In the event that a minor Participant is not allowed to attend an activity in the situation referred to in § 3.5 of the Rules and Regulations of the Classes, the Fee for that activity, if requested by the Participant, shall be refunded in full, unless the Participant makes use of the option to carry over the fee for the unused activity to the next activity.
- The manager shall make the reimbursement in cash or by transfer to the account indicated by the client.
§ 5 Amendments to the Rules of Procedure
- The Manager reserves the right to unilaterally amend these Rules for valid reasons.
- The following shall be regarded as valid reasons justifying an amendment to these Rules:
- changes in legislation;
- significant changes in the scope of the Manager's activities, in particular a change in the scope of the services provided or the introduction of new services or changes to existing services.
- The Manager shall inform Clients of any change to these Terms and Conditions by posting an appropriate notice on its website: www.airo.fun
- Amendments to these Terms and Conditions shall only apply to contracts concluded after the amendment date.
